What is CLAT EXAM

Law is a system of rules, usually enforced through a set of institutions. Laws can shape or reflect politics, economics and society in numerous ways and serves as a primary social mediator of relations between people. A lawyer, according to Black’s Law Dictionary, is “a person learned in the law; as an attorney, counsel or solicitor; a person licensed to practice law.” Law is the system of rules of conduct established by the sovereign government of a society to correct wrongs, maintain the stability of political and social authority, and deliver justice. Working as a lawyer involves the practical application of abstract legal theories and knowledge to solve specific individualized problems, or to advance the interests of those who retain (i.e., hire) lawyers to perform legal services.

The role of the lawyer varies significantly across legal jurisdictions, and so it can be treated here in only the most general terms.If the world of law inspires you and the system of justice fascinates you, a career in law is for you. Legal profession is a fast growing, lucrative and the most respected career in India today. It is a very exciting and adventurous career. To pursue a career in law, one needs to pursue professional law courses. Common Law Admission Test (CLAT) is a centralised test for admission to prominent National Law Universities in India. The test is taken after the 12th grade for admission to graduation (also known as Bachelors) courses in Law. This exam was conducted for the first time on 11 May 2008. A total number of 1037 seats from seven law schools were offered to be filled by the test. The results of the first CLAT were announced on May 19, 2008. The two-hour admission test consists of objective type covering questions on English, general knowledge, basic mathematics, besides legal and logical reasoning. The second CLAT, for the academic year 2009-10 is scheduled for 17 May 2009. This year eleven law schools are participating in CLAT.The paper which was supposed to be held on 17 May 2009 has been resheduled and has taken place on 31 May 2009 due to paper tampering.

The Common Law Admission Test (CLAT) would be conducted for the first time in May, 2008 and would be held every year on behalf of any of the participating institutes. The CLAT is expected to provide the students the ease of filling up a single application form to get admission to any of the participating institutes.

Scope of CLAT

A law degree can open the door to a wide variety of careers. Lawyers play an important role in society through the practice of law, which encompasses a multitude of activities. A strong education in law school also provides the ability to pursue employment opportunities outside of the legal profession in areas such as politics and business.

Types of Legal Practice

The practice of law takes several forms. The ways in which lawyers apply their expertise can be broadly categorized into the following practice types:

  • Private Practice: involves working alone or with partners in a firm to provide legal services to clients (individuals or corporations); some lawyers specialize in one or more practice areas while others engage in general practice.
  • Public Interest Law: serves low-income individuals, marginalized groups and social causes; practitioners may work for advocacy groups, legal aid clinics and other organizations with the goal of advancing an interest of the public.
  • Government Counsel: governments hire lawyers for legal advice and representation; lawyers directly employed by the government may work for ministries, government agencies and crown corporations.
  • Corporate Counsel: corporations can employ lawyers as in-house counsel; an in-house counsel works for a single company to advise on legal matters related to its business activities.

Practice Areas (Specializations)

The law impacts our lives in numerous ways, so naturally the legal profession covers many fields and allows for a variety of law careers. There are many types of lawyers – some practice in all areas of the law, while others choose to specialize. Here are some areas of specialization in law:

  • Administrative: branch of public law dealing with the relationship between individuals and the government; regulates the power of governmental administrative agencies and ensures fair implementation and administration of laws.
  • Civil Litigation: involves a lawsuit resulting from a dispute between private parties (individuals or corporations); civil litigation is concerned with matters such as breach of contract, debt collection, malpractice and personal injury.
  • Constitutional: branch of public law dealing with powers of the federal government and the division of powers between the federal and provincial governments; constitutional lawyers handle issues such as equality rights, freedom of expression, security and democratic governance.
  • Corporate and Commercial: deals with the formation and maintenance of businesses; corporate and commercial lawyers handle contracts, liability, mergers, structured financings and other business matters.
  • Criminal: governs crimes against the public and members of the public (as opposed to civil litigation which deals with private disputes); a criminal lawyer may work for the government as a prosecutor or represent the accused person as a defense lawyer.
  • Environmental: legislation and regulations relating to the interaction of humans with the environment; environmental lawyers deal with matters such as air pollution, wilderness preservation and waste disposal.
  • Family: applies to legal relationships between family members; issues in family law include marriage contracts, divorce, child custody, adoption, wills and estate planning.
  • Immigration: federal laws control the entry of non-citizens into the country; immigration lawyers assist clients in applying for entry, residing in the country and becoming citizens.
  • Intellectual Property: intellectual property refers to the ownership rights to certain kinds of creative endeavors; intellectual property law protects ownership through copyrights, patents, trademarks and industrial design registrations.
  • International: governs the interactions and relationships between nations; international lawyers may be hired by national governments and international organizations, or work in the private sector focusing on the interpretation of treaties and related laws.
  • Labor and Employment: defines the rights and obligations of employers, workers and union members; lawyers may advise management, labor or government on issues such as employment standards, workplace health and safety, and industrial relations.
  • Real Estate: deals with the purchase, sale, financing and development of land and buildings; real estate lawyers may work for developers, tenants, investors, banks or corporations on matters relating to residential or commercial real estate.
  • Securities: regulates the purchase and sale of securities (financial instruments such as stocks and bonds); securities lawyers typically work in law firms providing services to corporations and financial institutions or for governmental commissions focusing on regulatory compliance.
  • Tax: deals with the taxes levied by different levels of government; tax lawyers may advise corporations on tax strategies and implications of business transactions, or counsel individuals on matters such as legal wills and estate planning.
  • Other Areas: in addition to the practice areas list above, there are many other fields of specialization in the legal profession (antitrust, entertainment, health, municipal, sports, etc.).

Other Career Opportunities

The skills required for a law career can also be successfully employed in other professions. Law school education is very versatile and some students decide to pursue alternative careers upon graduation. Even lawyers who have been practicing for several years sometimes transition into other careers.

Eligibility

CLAT 2010 for Under graduate Programs

CLAT 2010 Eligibility:

To be eligible for taking CLAT-2010, a candidate should have passed Higher Secondary School/Intermediate Examination (10+2) or its equivalent examination with not less than 50% marks in aggregate (45% in case of SC/ST/OBC* and persons with Disability*). Age of candidate should not be more than 20 years (in case of General/OBC candidates and 22 years in case of SC/ST* and persons with Disability* on 1st July, 2010.

*Subject to reservation at the University concerned.

Candidates appearing in the qualifying examination can also appear provisionally. However, they shall have to produce proof of having passed the qualifying examination before or at the time of admission with detailed mark sheet.

Note: Candidate with compartment/supplementary in any subject in the qualifying examination will not be eligible for admission.

CLAT 2010 Pattern of the Test Paper for Undergraduate Programs:

  • Total Marks : 200
  • Total number of questions : 200

Subject areas with weightage:

  • English including Comprehension : 40 Marks
  • General Knowledge/ Current Affairs : 50 Marks
  • Elementary Mathematics (Numerical ability) : 20 Marks
  • Legal Aptitude : 45 Marks
  • Logical Reasoning : 45 Marks

CLAT 2010 for Post graduate Programs

The CLAT-2010 for the post-graduate programme (LL.M) will be applicable for admission to NLSIU, NALSAR, NLIU, WBNUJS, HNLU, GNLU, RMLNLU and RGNUL only.

For NLU, Jodhpur, candidates are required to apply separately to that University.

Eligibility for CLAT 2010:

To be eligible for appearing in the Common Law Admission Test CLAT to the two year LL.M. Degree Course, a candidate should have passed the LL.B/B.L. Degree or an equivalent degree from a recognized University with not less than 55% marks in aggregate (50% in case of SC/ST/OBC* and persons with Disability*).

*Subject to reservation at the University concerned. Candidates awaiting result of the qualifying examination can also appear for the test on the condition that they produce proof of having passed the qualifying examination with the prescribed marks before or at the time of admission.

Pattern of the Test Paper for Postgraduate Programme:

  • Total Marks : 200
  • Subject areas : Law of Contracts, Law of Torts, Family Law, Criminal Law, Constitutional Law and Legal Theory

Total number of questions:

  1. i.            Objective Type : 50 questions of one mark each
  2. ii.            Short answers : 10 questions of five marks each
  3. iii.            Essay : Two questions of 50 marks each

(Two sections containing three questions each out of which one from each section to be answered)

Course

Let me serve an entirely amateurish, layman’s key to clattering the CLAT, shredding the awe inspired by the CLAT to pieces. Inch by inch, Section by section rundown of the test.

Maths

This will either be a piece of cake or your biggest nightmare. Accordingly its role in your roster should vary. There’s really no study tip or special preparation that anybody can give you for math. The math involved is very basic and uses only primary concepts. Use the options; they are there for a reason. (If they really wanted to test your mathematical ability why would have they given you options)

Logic

Logic is a lot like math, but it’s easier to crack in a short time span. There are certain categories of questions in logic. Each of these categories has a certain way of going about

it. You should have enough opportunity to acquaint yourself with this section of the paper, besides all you require to crack this section is “Good Reasoning Ability” which cannot be taught, and comes naturally to you. The best thing about this section is that you can crack each question in this section without having done any similar problems prior to this test.

English

The only even remotely advanced area in the entire test is the vocabulary section. Grammar based questions: Most of you have done the rules of grammar in school and have devised your innovative rules and internalised them as well. You have reached that stage where you can make out if something’s wrong and with a sentence and what it is by saying it in your head. Just follow your hunch and back your instincts.

GK

This is the joker in the pack because the format may be fixed but there’s no way to predict the type of content. The GK section’s a lot easier now without the short notes, so make the most of that.  Also you’ll realise that a lot of what you have read during those history & civics classes in school, has actually stuck to the dark walls of your membrane. A lot of questions will seem familiar and even if you don’t remember the answer, one look at the options will make a lot of things clear to you. You’ll realise that your intuition will bail you out more often than not and a lot questions will just click on the spot.

Legal Knowledge

This constitutes a vital section of the paper. The questions also cover a vast scope. Pay more attention to the Constitution of India, and the events happening around you.

In the domestic sector,

Concentrate on all the happenings in the field of terrorism and the new laws to tackle it. Closely follow the legal issues associated with the Judges appointment, RTI, Bills, Telangana, Scams, etc.

One good way would be to look at all the commissions and committees set up, and the latest status regarding their functioning.

International sector:

Wars and human rights, and environment- these are the crucial topics.

The measures taken to curb international terrorism are also important. And I see no surprises.

Legal Reasoning

Go through the 5 rules again and keep applying them as and when required. After the Delhi and SET papers, you must have realised the importance of these rules and the questions/ exercises tested/ provided in your Modules. Go through them once again. If have already got the past year’s papers, then make use of them and plan your strategy for the exam day.
In the end, you’re the hero of this story and its end is in your hands. You could be lucky and have trouble in only one or two of these five areas or be dyslexic in all five. It may or may not pay off, but hard work’s the only way out. We often give up when the destination is closer than we may have imagined. Don’t give up just yet, you have dreamt and fantasised about NLSIU and strawberry field, this is the time where you stick to the fight. Give it all that you have and back yourself. Everything that is available to everyone is also available to you. Potentiality of one is potentiality of all. I’ll leave you with this quote from Balzac: “None is superior than what you can become”

There is no negative marking. YOU MUST ATTEMPT EVERY QUESTION.

Fees

Fee structure varies from institutes to institute and also from course to course and location and facilities given by institute like- hostel,kanteen etc.

However, fee structure for 1 to 3 is more or less near about 80,000/- annum including accommodations like-hostel,kanteen etc.
